Digital tachograph up-date
European legislation originally required the fitment of digital
tachographs from 5 August 2004. However, due to delays resulting
from technical complications this date has been moved forward to
1 January 2006. The law applies to new vehicles first put into service
from this date. Existing vehicles will be allowed to continue using
analogue tachographs under current legislation. Nor indeed, will
there be any prosecutions for non-fitment of digital instruments
prior to the revised mandatory fitment date.
The long-awaited digital - ‘smart card’ -
tachograph regulation 1360/2002/EC - amending regulation 3821/85/EEC
- and its technical Annex 1B were published in the Official Journal
of the European Communities (the OJ) on 5 August 2002. This date
signalled the start of an official 24-month count down to the
date by which such instruments had to be fitted and used in relevant
vehicles (ie originally 5 August 2004, but now 1 January 2006.
Thus from this date, the following vehicles will be required
to be fitted with digital tachographs:
All new goods vehicles over 3.5 tonnes gross
weight (apart from those specifically exempt under
the legislation), and
Existing ‘in-service’ vehicles
over 12 tonnes gross weight in which the existing analogue tachograph
fails and has to be replaced.
Vehicle manufacturers are installing these instruments in new vehicles prior to the ‘due’ date
and driver ‘smart cards’ are available now from
the Driver and Vehicle Licensing Agency (DVLA) to allow for driver training and familiarisation. Driver Smart
Cards cost £38 each.
